  	The estimate for John's birth date is based on two points. First, his mother, Judith, was apparently pregnant with her second child during Jun 1749. Secondly, he made choice of a guardian in 1764, a privilege which required the orphan to be at least 14 years of age.

  	On the above noted date, John was named as the orphan of John Herbert, dec'd, and made choice of Curle Tucker as his guardian before the County Court. John and Curle were 1st cousins, once-removed.

  	Judith presumed her son John to be living when she wrote in her will dated 16 February 1779 "...provided my said son John Herbert comes to Virginia in person to claim a moiety thereof..."
  never married	John apparently never married, and he left no children.

  	Thomas Owens deposed on 10 Feb 1831 before T. Webb, J.P. for Norfolk County, that he had been well acquainted with John Herbert who was a carpenter and midshipman in the Virginia State Navy during the Revolutionary War. He further stated that John, brother of Capt. Thomas "Silverfist" Herbert, entered the service at an early period of the War and that, to the best of his knowledge, he never returned.

  	Capt. Thomas Herbert's Norfolk County will of 17 Jun 1749 named John and Judith's eldest child, Margaret and alluded to a second child in his son John's family that had been conceived, but had yet to be born. Using this knowledge and applying the generally accepted rule of thumb that prior to 1850 a couples's first child arrived within a year of marriage and subsequent births usually occured at two year intervals thereafter [the intervals grew slightly as a woman aged], John and Judith's marriage date may be estimated as c. 1746.
