  	Joshua was named in his father John Herbert's will of the above noted date, indicating that his birth took place prior to that date.

  	Judith presumed her son Joshua to be living when she wrote in her will of the above date: "... provided my said son Joshua Curle Herbert comes to Virginia in person to claim a moity thereof..."

  	The only two records found to date that mention Joshua are his parent's wills. According to Judith Herbert's 1779 will, Joshua was not in Virginia. As the Revolutionary War was on going at that time, it might be supposed that he was a soldier or sailor fighting for the American cause. There is, however, no mention of him in extant Revolutionary War records. Joshua was not named in his sister Rosea Tyler Herbert's 1782 will. The will did name his siblings, Thomas and Pascow, suggesting that Joshua was deceased by the date of Rosea's will. Finally, Joshua was not named in any of the multitude of affidavits, depositions, letters, etc., that were submitted to the State of Virginia and to the US Government as relationship evidence concerning the division of the Revolutionary War Bounty Land Warrants due the heirs of his brother, Capt. Thomas Herbert. The ommision of his name as an heir, suggests that he predeceased his brother Thomas who died on 1 May 1799.

  	Capt. Thomas Herbert's Norfolk County will of 17 Jun 1749 named John and Judith's eldest child, Margaret and alluded to a second child in his son John's family that had been conceived, but had yet to be born. Using this knowledge and applying the generally accepted rule of thumb that prior to 1850 a couples's first child arrived within a year of marriage and subsequent births usually occured at two year intervals thereafter [the intervals grew slightly as a woman aged], John and Judith's marriage date may be estimated as c. 1746.
